Arequipa: Cobra claims US$ 120 million for delays in Majes II

Follow the novel. Hydropower project concessionaire, sued the Regional Government of Arequipa before SICRECI for non-compliance. In May it is decided if the work goes to arbitration or continues.

Cobra sued the Autonomous Authority of Majes (Autodema), before the State Coordination and Response System in International Investment Disputes (SICRECI) of the Ministry of Economy and Finance (MEF). The concessionaire that executes Majes Siguas II warns in a report damages and breaches of Autodema, after the signing of addendum 13.

René Cruz, Majes II Development Manager, confirmed that they will present their defenses.
SICRECI will listen to both parties, to see what agreements can be reached until May 8, the maximum term. The restart of works or an arbitration that paralyzes the work for the umpteenth time will depend on it.

The works were suspended by Cobra due to the rains. According to their schedule, they should be resumed between March and April, but with the pending direct deal, nothing is fixed.

Autodema’s executive manager, Ulises Aguilar Villavicencio, explained that there are nine groups of controversies in the lawsuit. They demand the delivery of control of the project (land for the execution of works) and approval of file No. 2. The official indicated that they have April 12 as the last deadline to cede the areas of the Pusa Pusa annex that will be flooded for the Angostura dam and those of Tarucamarca, entrance to the Condoroma dam.

Regarding file No. 2, Aguilar announced that Cobra unilaterally approved it, when it did not raise the supervisor’s observations. Of 358 objections, 159 remain pending acquittal. The transnational also indicates a damage of US$ 120 million. He accuses damages for the time delay in the execution of works. As of October it was US$90 million and to date it is around US$120 million. For the official, there is a feeling that the company wants to go to arbitration and not restart the work, Aguilar said at the meeting with the directors.

tunnels in question

Cobra plans to modify the Trasandino and Pucará tunnels that will carry the dammed waters of Angostura. Aguilar announced that this file has already been approved, now they want to change the construction methodology of Pucará. Cobra argues that because of the war between Ukraine and Russia it will no longer be able to count on a second tunnel boring machine. The official maintained that the tunnel boring machine was more efficient. “It is a request that has been included in addendum 13 for a new file to be approved,” said the official.v
