Intern contracts extended to 24 months

The government enacted Law 31396, which recognizes pre-professional and professional internships as work experience, in order to benefit students and graduates from universities and institutes.

Thus, an important change is generated in the duration of professional practices, given that the law modifies the training modality, extending its duration from 12 to 24 months, explained the labor expert. Ricardo Herrera.

“Interns can stay another year if their contract expires tomorrow. It is a subtle change because during the pandemic the boys have had problems to position themselves as interns. It serves to give them an opportunity,” he said.

It is worth emphasizing that the complementary provision of the standard indicates that graduates between 2019 and 2022 can accredit professional practices carried out up to 24 months after the lifting of the state of health emergency.

Likewise, Herrera considers that policies should be chosen that encourage the hiring of practices such as the exemption from payment of health insurance by the employer.

On the other hand, the lawyer Jorge Toyama considers that there is a great disconnection between the classroom and the workplace, since the State does not have a regulatory policy for technical and university careers.

:

“For example, Peru needs health personnel, engineers, technicians today more than ever, but the main thing there is is administrative careers, accounting, administration, lawyers, when the country needs those things. There is no coordination between the job offer, what companies need and what the State offers in terms of professionals. In other countries there are quotas, for example, this year 4,000 law students for all universities”, write down

Finally, he considers that it is necessary to avoid “taking the extreme turn” of the law, since if three years of experience were previously required, employers can now ask for seven.
