France Travail allows French workers who resign from their jobs under 17 specific circumstances to claim full unemployment benefits.

Under standard French labor regulations, voluntary resignation normally disqualifies an employee from receiving state unemployment support. However, the national employment agency recognizes exemptions for specific personal and professional reasons, enabling qualifying workers to access the jobseekers return-to-work allowance, known as the ARE.

Various workplace and personal pressures prompt employees to leave their positions, including forced relocations, a lack of career progression, overwork, and strategic or economic disagreements with employers. More than 5,400 employees resign every day in France, according to data from DARES, the research and statistics department of the French Ministry of Labour. The statutory research body estimates that 2.7 percent of French wage earners resign each year. Daily resignations surged following the Covid-19 pandemic before stabilizing at historical norms.

Standard resignations permit employees to terminate a work contract voluntarily without providing justification to their employer. Under French employment law, workers notify their employer, preferably in writing, and serve a notice period lasting between one and three months. Employees must also attend an exit interview with their employer to receive their legal exit documents. Because standard resignations do not grant state unemployment benefits, departing workers must rapidly find new employment or start a business.

Personal and relocation exemptions

France Travail limits legitimate resignations to 17 specific statutory cases. Personal and family relocations account for three main categories of legitimate exemptions recognized by the agency. Employees who marry or enter a civil partnership, known in France as a PACS, can claim benefits if they move home within two months of the event. This spousal provision also applies when a partner changes regions for professional reasons.

To receive payouts under marital relocation exemptions, workers must provide official documentation to France Travail. Required items include a family record book, an official copy or extract of a marriage certificate, or a civil partnership registration certificate from a judicial court registry, alongside proof of the new residential address.

Relocations linked to family care obligations also satisfy the agency rules. Parents may resign with full benefit rights if a child enters a care facility located outside their main area of residence. The rule applies to minor children who must move with their parents, as well as adult dependents under guardianship or curatorship who relocate to remain near their designated guardian. Applicants must present a family record book and an official certificate from the receiving facility.

Workplace offenses and legal protection

Safety concerns and criminal offenses within the workplace represent another major grounds for legitimate resignation. Individuals experiencing domestic violence, forced relocation, or violence within their workplace team can resign and collect benefits. The rule extends to workers targeted by workplace crimes under their employment contract, including sexual harassment, moral harassment, or death threats. Applicants must supply France Travail with an official receipt of their filed police complaint.

Workers can also trigger the legitimate resignation process when an employer fails to pay owed wages despite a formal court ruling. Additional special categories, including childminders and journalists, can access unemployment benefits after resigning under specific statutory conditions. While some resignations proposed by employers rely on financial transactions without genuine grounds, official France Travail exemptions guarantee legal protections for eligible staff.

France Travail, formerly known as Pole emploi until its restructuring in January 2024, acts as the public administrative body overseeing national employment services and unemployment benefit distribution in France. Its return-to-work allowance, or ARE, provides essential income support for eligible job seekers navigating career transitions.
