Minem temporarily suspends the obligation to commercialize biofuels

The Ministry of Energy and Mines (Minem) temporarily suspended the obligation to make biofuel mixtures and their commercialization in order to avoid affecting the supply of liquid fuels in the national territory. This is due to the possible interruption of the supply of fuel alcohol and B000 biodiesel in the supply plants in the north of the country as a result of heavy rains that cause damage to the main land routes in this area.

Thus, through Ministerial Resolution No. 111-2023-MINEM/DM published this Friday the 17th in El Peruano, it is excepted from compliance with articles 7 and 9, as well as from compliance with the provisions of the second paragraph of article 12 and the second paragraph of article 13 of the Regulation for the Commercialization of Biofuels, to agents that mix biofuels with fuels and to agents that commercialize and/or use gasoholes and B5 diesel.

The articles in question establish the minimum percentage of fuel alcohol with gasoline, as well as the percentage of B100 biodiesel in the B100 biodiesel mixture that fuels must have for their sale.

The legal provision also suspends the obligation for wholesale producers and distributors that have their own or contracted storage capacity in a plant, in the departments of Áncash, Cajamarca, La Libertad, Lambayeque, Lima, Piura and Tumbes, to have an average existence monthly minimum of each stored fuel, equivalent to 15 calendar days of its average dispatch of the last six days, as established by Supreme Decree No. 045-2001-EM.

The rule comes into effect this Friday for a period of 15 calendar days. However, it is indicated that the General Directorate of Hydrocarbons of Minem can annul the temporary exception measures or extend their term for up to 15 additional calendar days, depending on the permanence of the situation affecting the supply of liquid fuels, which motivates said exception.
