Peru transport regulator Ositran finalized 11 administrative sanctions totaling more than S/3.3 million against infrastructure concessionaires during the second quarter of 2026. The enforcement actions targeted companies operating port, rail, highway, and airport concessions across the country following breaches of contractual obligations and operating standards.
The port sector accounted for the largest share of the penalties, drawing S/2.3 million of the total amount. Regulators cited failures to meet mandatory service level and productivity commitments as the primary drivers of the port fines.
Port terminal penalties
The Organismo Supervisor de la Inversión en Infraestructura de Transporte de Uso Público, known as Ositran, oversees public transport infrastructure concessions across Peru. Official records show that operator APM Terminals Callao received two separate sanctions totaling S/2.27 million within the port category. Both fines stemmed from non-compliance with required service quality and operational productivity metrics established in its concession agreement.
APM Terminals Callao operates the Multipurpose North Terminal at the Port of Callao, Peru's primary maritime hub near the capital city of Lima. In addition to the monetary fines, Ositran issued a formal warning against a port operator for failing to comply with the General Tariff Regulations governing public port services.
The second-quarter enforcement figures reflect an ongoing supervisory effort by the regulator. In 2023, Ositran recorded 46 finalized administrative sanctions against transport operating companies, resulting in total fines of S/4.6 million.
Railways and metro line sanctions
Peru's railway sector and urban rail network incurred the second-highest volume of financial penalties during the quarter, with sanctions reaching S/925,320. Enforcement in this category focused on maintenance compliance and daily train operations.
Tren Urbano de Lima, which operates Line 1 of the Lima Metro electric passenger train system, was handed two administrative sanctions under its concession contract. Ositran determined that the company failed to perform general overhauls on train traction motors in accordance with its mandatory technical maintenance schedule.
The supervisory body also issued a formal warning to the rail operator following an incident involving the incorrect stopping of a passenger train during service.
Road concessions and toll breaches
Highway concessionaires faced administrative fines for customer service failures and improper toll collections. Autopista del Norte received a sanction of S/26,015 after failing to adhere to regulatory provisions regarding complaint management and dispute resolution procedures.
Carretera Andina del Sur, the concessionaire formerly operating under the name Survial, was penalized S/17,655 for contractual non-compliance. Ositran stated the company breached its concession agreement by failing to collect required toll fees at the Marcona and Pichirhua toll stations.
In addition to administrative sanctions, contractual penalties were finalized during the period. Sociedad Concesionaria Anillo Vial received a contractual penalty of S/149,800 for submitting required technical documentation late for section 1 of its highway project.
Airport operations and construction delays
In the aviation sector, Aeropuertos Andinos del Peru was fined S/31,790 over non-compliance involving the liquidation settlement process for operational co-financing. The company operates a network of regional airports in southern Peru.
Lima Airport Partners, the concessionaire managing Jorge Chavez International Airport in Callao, received a formal warning from Ositran. The regulator cited a failure to maintain required standards of cleanliness and hygiene on passenger terminal floors.
Concessionaire Aeropuertos del Peru was assessed a contractual penalty of US$73,000 for delays in carrying out scheduled improvement and rehabilitation works at Piura airport in northern Peru. Ositran noted that contractual penalties stem directly from specific terms written into concession contracts, whereas sanctions follow formal administrative violation proceedings.
Contractual penalties and future oversight
Urban transport infrastructure also incurred contractual penalties during the quarter. Sociedad Concesionaria Metro de Lima Linea 2 was penalized S/5,500 for failing to submit its monthly socio-environmental report within the contractual deadline. Ositran reported that no contractual penalties were finalized against port operators during the second quarter of 2026.
Looking ahead, Ositran indicated in its 2026-2030 institutional plan that its supervisory workload will expand significantly as new infrastructure projects come under its purview. Key projects entering heightened oversight include the Anillo Vial Periferico beltway, Line 2 of the Lima Metro, and the new terminal expansion at Jorge Chavez International Airport.
