Is it possible to park under the windows of the building? This is what Polish law says. The answer is not obvious

The number of parking spaces in Poland is growing year by year, but the number of parking spaces in cities is not increasing. This often leads to absurd situations. they steal and dismantle signs prohibiting parking, and sometimes even modify the restrictions themselves by painting over the boards. It happens that housing associations, especially in older housing estates, try to solve the problem as much as they can. Therefore, they designate parking spaces around the building or on the lawns, introducing resolutions allowing, among others, for parking right under the windows. Often this permission is limited to stopping the vehicle facing the building only. This is to reduce the risk of exhaust fumes entering the apartments and reduce noise. However, the rules of the communities should not be in contradiction with the Polish one.

Pursuant to § 18 and 19 of the Minister of Infrastructure of April 12, 2002 on the technical conditions to be met by buildings and their location, parking with 10 spaces can be 7 meters from the windows of the building. From 11 to 60 seats must already be at least 10 meters away. These provisions are invoked by persons who challenge the internal regulations of the community in court. mentions, among others about a woman from Bialystok who was fed up with parking in front of her bedroom windows. The district court agreed with her, but the appeals court ruled that the technical rules should not apply here. A similar case was also ruled by a court in Poznań a few years ago, which, in turn, decided that technical conditions can be used to adjudicate on the validity of resolutions of housing associations by a civil court.

Is there a penalty for the driver for fogging up the car in front of the windows of the building? If the vehicle makes it difficult to get in and out of the car park or garage, or if the vehicle is parked with the engine running for more than a minute, the driver may be fined. In other cases of parking in front of the windows, however, the city guard has no authority to intervene. The issue of parking around the building and in front of the windows is regulated primarily by the law and regulations on road traffic. If there is no no-parking zone in the vicinity of the building, indicated by appropriate road signs, resolutions of housing associations are of further importance. In the absence of bans or regulations by the communities, it is worth remembering that parking in front of the windows of neighbors can be a nuisance for them.
