How do I know if I have already been paid the gratuity?

The payment of bonuses is another date that is long awaited by the worker because it is highly relevant to their economy. This bonus is delivered up to July 15 and December 15, to be specific, for the National Holidays and Christmas celebrations. The employees who are entitled to this are those who are subject to the private, agricultural, micro and small business regime and those of public entities under the labor regime of private activity.

What happens if the company does not deposit the gratuity?

If you believe that you are entitled to this pay and your company does not do it on time, they will be fined. This penalty fee ranges from S/7,222 to S/120,152 soles, according to the number of employees who did not receive this money and the amount of the ITU in effect. In turn, the respective legal interests that are generated until the effective date of payment will be applied.

How to get the bonus account?

To calculate the gratification it is necessary to take into account what a worker earns per month and the time he is in service. We divide all the earnings by six to obtain a gross monthly salary and to this result we add 9% of it according to the concept of isHealth or only 6.75% if it is EPS. A full month is considered if the person worked at least 15 business days per month. When is the bonus deposited?

according to article 5 of the Law 27735, the first gratuity must be paid at the latest before July 15, before National Holidays. And the second, at most, on December 15, before Christmas. In the event that the fortnight does not fall on a business day, the payment must be made the day before the date.

When is the July bonus paid?

According to the schedule, the gratification to come must be remunerated next Friday, July 14. This is because the 15th will be Saturday and, therefore, it does not correspond to a business day.
