Workers in Spain are entitled to up to nine statutory paid leave options in 2026 under national employment laws, with several leave allowances expected to expand during the year.

Sources from the Ministry of Work said government officials plan to review workplace leave entitlements to better accommodate remote working arrangements and family care responsibilities.

Entitlements for bereavement and family emergencies

Under current regulations, employees receive two days of paid leave following the death of a family member. Ministry officials are examining a proposal to increase the bereavement allowance to ten days to support grieving families.

Marriage or registering a civil partnership grants workers 15 consecutive days of paid absence, which remains one of the most widely used entitlements in Spanish labor law.

Employees are also entitled to five paid days off in the event of a serious accident or grave illness affecting a family relative up to the second degree of kinship.

Workers can claim four days of paid leave during official travel restrictions or severe weather conditions that prevent them from traveling to their workplace.

Force majeure, relocation and public duties

The legal framework includes four days of paid leave for force majeure situations. This allowance applies when a cohabitant or relative suddenly falls ill and requires urgent attention.

Employees who move to a new primary residence are entitled to one paid day off. Legal analysts noted that many workers remain unaware that this moving entitlement is fully active.

The law guarantees necessary time off for workers to perform mandatory public duties, such as voting in elections or appearing in court proceedings. The entitlement covers both the required attendance time and travel to and from the venue.

Parental rights and professional development

In healthcare and family care, regulations guarantee necessary leave for prenatal medical exams and childbirth preparation classes. Employees also receive breastfeeding leave, which can be taken as daily time credits or accumulated into full days off.

Workers receive 20 hours of paid vocational training leave each year. The training allowance is designed to build professional skills and assist workers with internal career promotion.

The entitlements are established under Spain's Workers' Statute, known as the Estatuto de los Trabajadores. The statute serves as the primary legal framework governing employment contracts and mandatory workplace rights across the country.

Labor law experts said legal trends point toward increasing paid leave for severe family illnesses and introducing greater flexibility for professional training hours as reforms progress through 2026.
