Cardona advised that people should act with caution before making definitive decisions, adding that following these five steps will help heirs avoid unpleasant surprises.

Requesting property records

The first fundamental step Cardona raised is to request a short property registry report, known as a nota simple, for the property from the relevant registry.

Cardona explained that this document is essential because it allows the heir to ensure who the owner is and whether there is any type of mortgage, embargo or other type of charge weighing on the asset.

Secondly, the specialist placed special emphasis on the need to carry out an exhaustive review of debts. The professional said that accepting an inheritance does not always mean only receiving positive assets, warning of the hidden financial obligations that can accompany the succession process.

In this regard, Cardona pointed out that an inheritance brings not only assets, but can also bring loans, pending bills or other payments of which the heir had no record. This prior check prevents heirs from assuming unforeseen economic commitments linked to the deceased or the property.

Tax obligations

The third step the lawyer noted focuses on accurately calculating inheritance tax, a procedure that has a specific legal timeframe. The expert highlighted that there is a deadline to present it and that the final amount will depend on multiple regulatory factors applicable to each case.

Cardona specified that the amount of this tax will depend on the autonomous community, since it is not paid equally in all of them, as well as on the kinship and the value of the inherited assets.

As a fourth step in this legal guide, Cardona urged people to review the municipal capital gains tax, a local levy charged by town halls when property is transferred.

The expert explained that the town hall will ask the heir to settle this tax to check the increase in the value of the land on which the home is located from the time it was acquired until it was transferred.
