Harvey Colchado Prosecutor Requests Nine Years in Prison

Anti-corruption prosecutors in Lima have requested a prison sentence of nine years and four months for lawmaker Harvey Colchado over alleged charges of incompatible negotiation and ideological falsehood.

The formal penalty requirement was submitted by Prosecutor Diana Mayra Paico Guevara of the Second Corporate Provincial Prosecutorial Office Specialized in Corruption of Officials Crimes of Lima Centro.

According to the prosecution theory, the Ahora Nación party deputy entered false information into a public document by stating that his occupation was independent, even though he was actively serving as a colonel in the National Police of Peru.

Prosecutors charged Colchado as the author of ideological falsehood and as an accomplice in incompatible negotiation. The case now awaits review by the Judiciary, which will evaluate the filings to decide whether the matter proceeds to trial.

Responding to the fiscal request, Colchado stated that authorities would not manage to intimidate him and affirmed that his commitment against corruption remains firmer than ever. Speaking in his capacity as a citizen and elected representative, he expressed absolute conviction in his innocence regarding all allegations.

Colchado noted that throughout his professional career he has fully respected, and will continue to respect, the autonomy of the Public Ministry and the independence of the Judiciary. He remarked that anyone who has spent his entire life working to enforce the law will never place himself above it.

The deputy emphasized that while the allegations remain under official investigation, he retains the right to the presumption of innocence guaranteed to every citizen. He expressed confidence that an objective, impartial, and respectful legal process will allow the truth to prevail over the charges.

Ethics appointment and legislative background

Colchado serves as second vice president of the Chamber of Deputies and was recently designated as a member of the Parliamentary Ethics Commission. Within Peru's bicameral congressional framework, the Chamber of Deputies forms the lower house of the national legislature, while the Ethics Commission oversees internal investigations into congressional conduct and compliance standards.

The lawmaker asserted that it was impossible to ignore that the legal complaint became public precisely as he assumed his responsibilities on the Ethics Commission. He insisted that he will not allow any judicial investigation to be converted into a tool or instrument of political pressure.

Anti-corruption record and institutional framework

Addressing his background in law enforcement, Colchado highlighted that he has spent years confronting organized crime and investigating figures who held concentrated political power. He declared that his stance against corruption would not alter due to a criminal complaint, especially in his current position as an authority, and promised to maintain the firmness, honesty, and independence that have defined his career.

Under Peruvian law, the National Police of Peru operates as the primary state agency responsible for law enforcement and internal security. The Public Ministry functions as an autonomous constitutional entity charged with directing criminal investigations and bringing charges, while the Judiciary operates independently to adjudicate legal proceedings.
