The relatives of the victims for whom the recently released former president was sentenced to prison Alberto Fujimori They asked on Friday Inter-American Court of Human Rights (IAC Court) that points out Peru as a country that disobeys orders from the highest regional human rights court.
Gloria Cano, the lawyer for the 25 victims for whom Fujimori was sentenced to 25 years in prison in 2009, told the press that they have also asked the Inter-American Court to issue a report to the General Assembly of the Organization of American States, so that it can issue resolutions that force Peru to abide by the rulings of the Court.
“This possibility is framed in the American Convention as a collective guarantee for states to fulfill their duty to comply with all the mandates of the Inter-American Court,” Cano indicated.
Cano, who has been a lawyer specializing in human rights for more than three decades, commented that a “serious precedent” in Peru to disregard any provision of the Inter-American Court.
“What is at stake is hope, the legality of an Inter-American order in which any citizen can resort to the denial of justice in the domestic forum,” he added.
The Inter-American Court on Tuesday asked Peru to refrain from executing the order of the constitutional Court Peruvian law that ordered the immediate release of the imprisoned former president until the Court has the elements to analyze whether the decision meets all the conditions.
The Court indicated that it was making the request for “guarantee the right of access to justice” of the victims.
But the government of the president Dina Boluarte decided on Wednesday, without explaining the reasons, that it was going to obey the Constitutional Court that with a controversial decision revived a humanitarian presidential pardon granted in 2017 by the then president Pedro Pablo Kuczynski (2016-2018).
The experts interpreted that Kuczynski granted pardon to Fujimori solely to gain parliamentary support for his weak government from legislators of the Fujimori party. The pardon was annulled by the Peruvian justice system in 2018 and Fujimori returned to prison until he was released on Wednesday.
Fujimori, 85, was released on Wednesday amid the happiness of his followers.
He did not repent for his crimes nor pay civil reparation of US$15 million, according to the anti-corruption prosecutor’s office.. On the contrary, he said in October that he was innocent of the 25-year prison sentence for the 25 murders that a clandestine group of soldiers committed under his knowledge during his administration (1990-2000) in the context of the fight against the terrorist group. Luminous Path.
The former president has three other sentences for corruption, but the law indicates that the sentence is served with more years in prison.
After a decade of government, Fujimori fled to Japan in 2000, where he resigned following various corruption scandals, including the release of a video in which his administration’s spy chief was observed handing out wads of cash to opposition congressmen. In 2005, he traveled to Chile where he was arrested and then extradited to Peru in 2007.
