That the Prefecture of Pichincha enter documentation regarding the socialization of the ordinance for the creation of the Special Fund for Road Improvement and Maintenance of the Province of Pichincha with Citizen Contribution, before it comes into force, is what was requested this Wednesday morning by the judges who analyze the protection action raised against the tribute by Darío Paladines, representative of the Used Vehicle Automotive sector and president of the National Association of Ecuadorian motorcyclists.

The constitutional measure was filed because it would not agree with the collection of the so-called “solidarity rate”, that would seek to obtain resources to exclusively invest in the maintenance and improvement of the roads of the 53 rural parishes that Pichincha has. The hearing on this issue was installed after 08:30 this Wednesday at the Quitumbe Judicial Complex, in the south of Quito, and was suspended hours later, around noon.
The contribution would be based on the annual registration fee in the province of Pichincha and will be paid once a year. From this 2022, public and commercial vehicles must pay $20.50; private vehicles, $18, and motorcycles, $9.30.
After the suspension of the audience, Sebastián Espinosa, lawyer for Paladinespointed out that they are waiting for the court to set a new date for the hearing to be reinstated and to analyze the documents that the representatives of the Prefecture will enter into the case.
Pichincha carriers reject registration tax approved by the Provincial Council
“It has been documented that there is no generating event in the ordinance approved by the Prefecture of Pichincha, that is, there is no legal-tax relationship and, if there is no the same, it cannot be given way, the tax obligation cannot be born. In this sense, this obligatory tax or this special contribution could not be collected from citizens,” Espinosa pointed out.
The protective action is being known by the judges Wilson Caiza (rapporteur), Mirian Escobar and Rita Gallegos. They announced that, once the requested information is delivered and in accordance with the agenda they manage, they will notify in advance about the reinstatement of the diligence. (I)
