Older adults who lack the means and resources for their subsistence or who, due to their physical or mental condition, cannot support themselves on their own, will receive alimony from their family members.
The Ministry of Economic and Social Inclusion (MIES) published the first Table of Minimum Alimony Pensions for this population group, which complies with a provision of the Organic Law of Older Adults, which was issued more than two years ago, on 9 May 2019.
The presentation of the table was held on December 22, in Quito. Esteban Bernal, head of MIES, said that this tool “will allow older adults who are in a situation of poverty, extreme poverty and vulnerability to have a dignified aging and that their family members are responsible for their care and happiness.”
Those who will pay, in the first instance, will be the children and even the grandchildren. The right is extended to the fourth degree of consanguinity and second degree of affinity, if the judge considers applying a protection measure, the MIES specified.
Bernal reported that in the next few days an agreement will be signed with several universities, “so that in each region of the country there is a free clinic where the good citizen can go with the elderly to ask that their relatives be required to provide coverage. ”.
The family, childhood and adolescence judges will establish the amount of the minimum alimony that the plaintiff can request.
The value will be calculated taking into account the basic unified salary (SBU), set by the Ministry of Labor, the accumulated annual inflation and according to the economic indicators determined by the National Institute of Statistics and Censuses (INEC).
In a statement, the MIES presented an example:
If the obligor earns $ 830, he would have to pay the elderly person a pension of $ 242.86 (29.26% of income). Additionally, $ 51.40 (12.85% of the SBU) will be paid if the beneficiary has a very serious disability; if the disability is classified as serious, the amount will be $ 40.56 (10.14% of the SBU); and $ 35.32 (8.83% of the SBU) if it is moderate.
For this purpose, the State Portfolio issued the table in a ministerial agreement on December 21. The instrument is made up of six levels, which determines the percentage that the obligors must pay according to their income and the number of older adults. The levels range from $ 0 to $ 399 for the first level, and from $ 1,224.01 onwards for the sixth level.
The percentages of the Minimum Alimony Table will be updated as of January 2022, once the new basic salary of $ 425 comes into effect. (I)
