Russian employers will not be able to terminate fixed-term employment contracts with mobilized and SVO participants who hold government positions. The State Duma adopted such a law on January 25, writes Parlamentskaya Gazeta.
The authors of the project noted that the majority of civil servants work under a fixed-term employment contract, and these amendments “will ensure the automatic extension of fixed-term employment contracts with those mobilized and are guaranteed to retain their jobs.” The project proposes suspending the terms of fixed-term service contracts of civil servants and their renewal after the person has returned after serving in the ranks of the Russian Armed Forces or the National Guard.
The period for which the service contract will be renewed is proposed to be set equal to the balance at the time of its suspension. At the same time, all orders to terminate employment contracts issued after September 21, 2022 with civil servants who went to the front will be declared invalid.
The rules, however, will not apply to those who were hired for a deliberately temporary job and the period of this work has ended, as well as to those who were hired to replace another absent employee.
We would like to add that in 2022, a law was passed on preserving jobs for mobilized, contract soldiers and volunteers while participating in hostilities, but the current rules still made it possible to dismiss workers who were called up for mobilization or who went to participate in the military military service voluntarily. Therefore, additional measures were needed, the authors of the initiative specified.
