General Víctor Araus appears at the Police Headquarters after protection action was accepted

“We are here complying with a constitutional provision, in the most respectful and disciplined way. as it characterizes us all the policemen. We are going to introduce ourselves before my general commander to receive his dispositions and what his authority determines ”.

That was the statement made by General Víctor Araus before entering, this Thursday morning, to the General Police Command, located in the north of Quito, Place to which he appeared one day after the constitutional judge Verónica Medina accepted the protection action that he presented and annulled the cessation of functions that was determined for him and three other officers in the rank of generals.

The decision caused the qualification with which Araus was dismissed to be annulled and benefited three other generals of the 50th promotion.

Araus’ lawyer, Diego Chimbo, explained that the constitutional justice granted the protection action proposed by his client and thus it was recognized that the right to security was violated to the guarantees of due process, to the guarantee of motivation and therefore the right to work.

“As a comprehensive repair, it was ordered that everything be rolled back at the time of the qualification of general aspects, that is, that General Víctor Araus is reinstated to functions. This as a result of it being tested in constitutional hearing of protection action that the mandatory meeting between the ex-minister (of Government) César Monge and the commander-in-chief Tannya Varela did not take place ”, explained Chimbo.

After a meeting within the Police Headquarters, Generals Araus, Pablo Rodríguez and Paulo Terán, all part of the 50 promotion and those who were dismissed in their functions last August, by means of Presidential Decree 146. The four generals were separated for not having fulfilled the requirements, but Araus’s defense argued that the Presidency of the Republic was misled, since the meeting was not held because of obligation it had to exist between the minister of government and the commander-in-chief.

General Araus pointed out that the order is for them to appear next Monday at the General Command to be notified of the new functions. Chimbo believes that this is the right thing to do, because being a constitutional provision is immediately enforceable. If the decision is not fulfilled, the official who does not comply with the judicial provision could be dismissed.

The constitutional action proposed by Víctor Araus was against the General Command, the Ministry of Government and the Presidency of the Republic. The decision had already been appealed, but Chimbo maintains that despite this, the resolution must continue to be complied with.

When Araus was consulted about whether he will undergo a new qualification for promotion, the officer said that this will have to be determined based on the process and it will have to be treated as things unfold.

Chimbo recalled that regardless of the constitutional process, the Prosecutor’s Office advances the criminal complaint that they raised for the crime of ideological falsification against General Tannya Varela.
