The judge who granted alternative measures to Geovanny R., involved in a triple crash registered on the road to the coast, justified his decision and gave the reasons why he did not order preventive detention.
Augusto García attached a document to the process in which he indicates that preventive detention proceeds only at the request of the Prosecutor’s Office. “In this case, the Prosecutor’s Office requested non-custodial precautionary measures, so this judge could not analyze, much less impose preventive detention when it was not requested,” he said.
Geovanny R. is one of the drivers involved in this accident in which people were injured and one died. He was ordered to be banned from leaving the country and regularly presented before a prosecutor once a week.
Ridler Acuña, provincial head of the Ecuadorian Transit Commission (CTE), indicated that one of the vehicles invaded the lane and then crashed into the vehicles.
After the accident, videos allegedly of the man in an apparent alcoholic state circulated on social networks. In the videos, presumably beer bottles are seen inside the car.

Judge Augusto García maintained that although reference is made to indications of an alleged state of drunkenness of the defendant, the Prosecutor’s Office and the arresting agent of the Ecuadorian Transit Commission explained that the citizen had not been able to carry out the alcohol sensor test (blowing ) due to the blows suffered in the traffic accident and that for this reason a blood test was carried out.
This last investigative procedure serves to determine whether or not the defendant was intoxicated at the time of the traffic accident.
According to the judge, up to the time of the hearing, the Prosecutor’s Office did not have the results of the examination, and he urged the Prosecutor’s Office to take the necessary and immediate steps so that the result of the blood alcohol test is sent as soon as possible and within legal deadlines.
The judge said that if the result of the blood alcohol test is positive, what would proceed is for the Prosecutor’s Office to request the reformulation of charges given this constitutive aggravating factor of the criminal type.

In his brief, the judge indicated that he heard this case as the person in charge of this office in the absence of its titular judge Leonardo Lastra Lainez, who is being compensated for the act of flagrante delicto.
