According to the law, the heir has exactly six months from the date on which he learned about the inheritance to decide whether to accept or reject it. This is regulated by Art. 1015 of the Civil Code. However, it sometimes happens that he has no idea what it consists of, so before making a final decision, he should check it so as not to take over the debts of the deceased. If it turns out that you will also inherit the debt along with the inheritance, you can reject it or accept it along with the benefit of the inventory. This means that the receivables will not be higher than your entire estate, which will protect your assets. Just remember that in this case you still have to pay it back. So how do you determine what an inheritance covers?
Is it possible to find out what is inherited? You will do this in two ways
The first method is nothing more than figuring out what it contains yourself. To do this, it is best to start by contacting the deceased’s other relatives who will help you. In addition, try to obtain information yourself, including from banks or loan companies. However, keep in mind that if you are not the actual heir, they are not obliged to provide information about any debts or assets. Additionally, this method requires some perseverance and time.
Where to check what is inherited? Not only in court
The second method, on the other hand, is much more effective and does not require such commitment, but it is much more expensive. We are talking about an inventory list, i.e. a document that clearly and precisely determines the value. This is nothing more than a very detailed and specific list of everything that is inherited. You will also find potential debts there. To receive it, you must submit an application with your data, the data of the deceased person and other heirs. It will also be necessary to attach a shortened death certificate of the testator. You can submit an inventory request in two places. The first one will be a specific court. What?
- If the testator lived in Poland, choose the court competent for the deceased’s last place of residence.
- If he lived abroad, this will be the court competent for the place where the inheritance or part of it is located.
- If you do not know where the inheritance is, the appropriate place to submit the application is the district court of the capital city of Warsaw. Warsaw.

How to find out what is included in the inheritance? Submit an application
Taking an inventory with the help of the court costs approximately PLN 500, of which PLN 100 is court fees and PLN 400 for the bailiff who performs it. Sometimes an appraiser’s valuation is also needed, which may increase the rate. It is also worth knowing that the court procedure takes time. If you want everything to be settled faster, skip the court and report directly to the bailiff appropriate for the area., where the testator lived before his death. The application and attachments are the same. If you feel like it, vote in our poll below.
