According to radiogdansk.pl, the District Court of Gdańsk-Południe passed a verdict in the case of insulting religious feelings by the leader of the metal band Behemoth, Adam Darski. The musician was acquitted of two charges, and in the case of the third charge, the court conditionally discontinued the proceedings.
Nergal was sentenced for insulting religious feelings
Nergal was in court because of a video he posted on his social media. The musician recorded a video for Women’s Day in which he sang a children’s song and waved artificial male genitalia with a figurine of Jesus attached to them. Judge Karolina Kozłowska found that the accused had broken the law, but conditionally discontinued the proceedings for a probation period of two years.
– This is a certain chance given to the perpetrator, after the successful expiry of the probation period, to prove that he understood the reprehensibility of the conduct, and thus to guarantee the acceptance of applicable standards in the future. Considering the fact that many of the accused’s behaviors are subject to criminal and legal assessment as a result of numerous previous notifications, mainly from politicians and church institutions, it is important that with this judgment the court makes the accused aware of the limits of exercising the right to creative expression, and the notifying parties – the scope of protection of their rights. – explained the judge.
Fine for Nergal
Adam Nergal Darski must pay PLN 2,000 to the Victims’ Assistance Fund and Post-penitentiary Assistance. The musician did not appear in the courtroom to hear the verdict. The judgment is invalid.
The dropped charges against Nergal also concerned his posts on social media. The first involved the musician showing a photo presenting two sculptures of male genitalia with images of Christ, which he posted on Instagram on December 24, 2016. One of them presented the crucifixion, the other the ascension. Nergal signed the photo with a question in English: “Are you celebrating already?”
The second allegation concerned a photo from March 19, 2017. Then Nergal published a photo with another man, in which the artist holds a sculpture of a penis with a crucifix in his hand. District Court Judge Karolina Kozłowska emphasized that in the case of both of these charges, “it should be noted that the accused’s behavior does not indicate that his purpose was to offend anyone.”
Additionally, “it should be noted that the injured parties did not submit the notification immediately after the entries were published, but only when submitting the notification after the act committed on March 8, 2018, i.e. a year after the entry from March 2017,” reports wnp.pl.
