The barbecue season lasts from May to September, but of course everything depends on the weather. This year we were greeted with beautiful sunshine, so the Poles took out their barbecue equipment. Skewers, chicken wings, sausage, black pudding or pork neck are just some of the things that can be put on the grill. Residents of apartment blocks look at it with relish and wonder if they, too, can barbecue. What do the regulations say?
Can you have a barbecue in front of the building? Theoretically yes, practically not entirely
Owners of single-family houses have a lot of freedom when it comes to grilling. If your behavior does not disturb public order and the general well-being of other residents, you can safely barbecue in your own home. There are no regulations prohibiting barbecuing on the lawn in front of the building or on the balcony. This does not mean, however, that the regulations of the cooperative or housing community allow it.
Additionally, lighting a barbecue in the garden must comply with the regulations set out in the Ministry of Interior and Administration regarding fire protection of buildings, other structures and areas. There is a provision that “it is prohibited to light a fire in a place where flammable materials or adjacent objects could ignite.”

If you light a barbecue in the garden in front of your apartment building, your neighbors may report you to the police or municipal police under the Civil Code, which prohibits immission. If smoke and unpleasant smells seep into your neighbors’ apartments due to your grilling, this may be considered behavior that prevents others from using the premises. For such an offense you can receive a fine of PLN 500. If you also behave too loudly, you may also be punished under the Code of Petty Offenses, which includes disturbing the peace.
