The constant struggle of the Bieniek family for a functional bathroom was publicized in a Polsat program. A married couple who live in one of the premises in a tenement house in Gdańsk have been struggling with the consequences of illegal construction since 1986. The “renovation” that led to the devastation of their bathroom was carried out by a neighbor from the floor above.
For 15 years, Mr. and Mrs. Bieniek have been unsuccessfully forced to live in an apartment with a makeshift bathroom, the ceiling of which is held up by wooden beams to prevent it from collapsing. – Renovation took place in 1986. This reconstruction was inconsistent with the permit that was issued. We found out about it only after a construction disaster occurred, when our bathroom broke down and it fell apart – described Mr. Jerzy Bieniek in an interview with “Interwencja”.
The mentioned neighbor, in turn, claims that they had the necessary consents. – It was about straightening the slopes, we had permits (…) – she said. But he also confirms that the renovation “exceeded the scope of the permit.” – Yes, but these are small changes that do not affect the substance of the building – says the woman.
My neighbor did renovations and the ceiling collapsed. “We had one stink here”
The construction disaster mentioned by Mr. Jerzy Bieniek occurred in January 2009. The couple suddenly heard a terrible noise. The ceiling in the bathroom began to collapse.
In my opinion, a truck passed by and it just crashed, the tiles piled up on the walls and fell off. The entire plumbing in her bathroom was simply not done properly, leaking and flooding. Because the ceiling itself didn’t rot, it just rotted because it was flooded regularly. We had one stink here
– Mr. Bieniek told a Polsat journalist. His wife, in turn, recalled a piercing noise. – There was a bang, tiles fell, that’s all I remember, because I was in shock – she said. It turned out that the Bieńkos’ apartment was regularly flooded by the neighbor, which resulted in the ceiling collapse.
Then you had to act quickly. A makeshift solution was to support the ceiling with two wooden beams. This is how marriage functions to this day. And although the construction supervision ordered the neighbor to restore the building to its pre-renovation condition, no steps have been taken in this regard for 15 years. According to the couple, the woman was supposed to appeal against the decisions.
“It’s really hard”
Although wooden beams keep the ceiling from collapsing, they also make the room significantly more difficult to use. The situation of the Bieniek family is truly serious. – I’ve had enough of everything – confessed Mr. Jerzy Bieniek. Mrs. Bożena Bieniek, in turn, confesses that “you can’t bathe properly.” – Do everything while squatting – he adds.
After all, I have to wash my hair and wash myself every day. I have to hold on to this beam and pass. It’s hard, really hard
– says Mrs. Bieniek. When asked by a Polsat journalist, the neighbor claims that she did not cause the damage on purpose and that she does not have the funds to cover the renovation costs. In its latest decision, the Administrative Court ruled that the renovation was to be covered from the funds of the housing community. However, this would increase the rent for the residents, which is why the couple does not want to agree to this solution.
