Engagement is undoubtedly one of the most beautiful moments in life. Over time, however, the harsh reality may surprise engaged couples and they will come to the conclusion that it is better to break up. Is compensation due for a broken engagement?

Yours went to the next level: he proposed, and there was a beautiful ring on your finger. You informed your family and friends and had a honeymoon of sorts. Then you start living together, talking about each other, and it turns out that you don’t suit each other at all. It happens, but what about the ring and declarations of love? Can I claim any compensation?

Can you break off an engagement? What does it look like from a legal perspective?

After World War II, there was a provision under which a person injured after breaking off an engagement was entitled to appropriate compensation. Currently, there is no such status as engagement in the Polish legal system. The fiancée is not treated like family, and the engagement ring is a voluntary donation.

However, in the event of a breakup, you can seek compensation. The basis for this is the Civil Code, which provides for causing damage to another person and the obligation to repair it. There is one condition: the claim for compensation for damage expires after three years from the date on which the injured party learned about the damage.

The man can apply for the return of the ring. There are two ways: revoking the donation or recognizing the engagement ring as an undue benefit. The first option is to prove your ex-fiancée’s gross ingratitude. Revocation of a donation must be made in writing. If a woman destroys a ring, she is obliged to repay its value. In the case of an undue benefit, it must be proven that the purpose of the benefit was not achieved. If the goal was a marriage that did not take place, the former fiancé may seek the return of the benefit, i.e. the engagement ring. In this situation, it doesn’t matter who was at fault.
