More and more couples who got married in a church are trying to have their marriage annulled – according to reports from ekai.pl in January 2023. At that time, there were as many as 700 cases of this type pending in the court docket of the Diocesan Court in Tarnów, and in 2022, 170 new lawsuits were accepted there. This year the situation has not improved at all.
On the contrary. As it states, for example, citing data provided to the Catholic Information Agency by the Tarnów Diocesan Court, we are dealing with a certain record. Currently, there are approximately 700 proceedings pending regarding the annulment of church weddings, while 164 new applications have been put on the docket in 2023. A total of 197 cases were concluded last year. The Tarnów court issued 175 judgments, 146 of which resulted in annulment. This is the highest number in the history of the court in Tarnów.

We wrote about why more and more couples nowadays decide to annul their wedding, among others: in November 2023. According to the report of the Statistical Institute of the Catholic Church quoted at that time, every fourth judgment in 2020 in favor of declaring the invalidity of marriage in the Church in Europe was issued in our country. “The number of declarations of marriage invalidity in the Church in Poland since 1989 has increased by over 160% compared to 2020 and amounted to 2,813,” it was emphasized.
Church lawyer Michał Poczmański from the Canonical Office in Warsaw spoke about the causes of this phenomenon in an interview with our journalist Natalia Kondratiuk-Świerubska.
First of all, relationships fall apart faster these days. Secondly, people are more aware of this issue than a few or a dozen years ago. And thirdly, the process for declaring the invalidity of a marriage in the Church was significantly simplified a few years ago
– he said. He then recalled that thanks to the reform carried out by Pope Francis in 2015, the procedure had become much shorter. Previously, a case had to be heard in two instances, but now there is only one. The proceedings therefore last approximately 2-3 years, not the previous 5 or 6 years.

Finally, he pointed out that the example comes from above – more and more public figures, declaring themselves as staunch Catholics, apply for the annulment of their marriages. One of the most famous cases is the former president of TVP during the PiS era, Jacek Kurski. After 24 years of marriage to his wife, with whom he had three children, Kurski annulled it and took another church wedding with Joanna Kurska, with whom he had a daughter. – (…) People often think: If Kurski got his divorce annulled, why shouldn’t we succeed? – commented our interlocutor.
Let us remind you that within the meaning of canon law, divorce is possible only by obtaining a declaration of the invalidity of the marriage.
