The National Court Register rejected the request of the Minister of Culture, Bartłomiej Sienkiewicz, to register new members of the supervisory board of Telewizja Polska.

On December 19, Bartłomiej Sienkiewicz, Minister of Culture and National Heritage, invoked the Commercial Companies Code and dismissed the presidents of public media management boards and their supervisory boards. The case concerned Polish Television, Polish Radio and the Polish Press Agency.

“The necessity and justification for this type of action was determined by the resolution of the Sejm of the Republic of Poland of December 19, 2023 on the restoration of legal order and the impartiality and reliability of the public media and the Polish Press Agency,” the ministry said in an official statement at the time.

According to President Andrzej Duda and other Law and Justice politicians, these changes are illegal. Mariusz Błaszczak announced an attempt to dismiss the minister, who, according to the PiS club, had “violated the constitution by depriving the rights to information, as well as violating other acts, including, above all, the act on radio and television broadcasting.”

On January 9, the registry court rejected Sienkiewicz’s request for changes in the supervisory board and management board of TVP. In the justification we read that the changes introduced “were undertaken by an unauthorized body in accordance with the above-mentioned provisions of the UKRRiTV (Radio Broadcasting Act – editor’s note), and also, due to the provisions of TVP’s statute, in accordance with the provisions of the Commercial Companies Code itself (Code of Companies). commercial – editor’s note)”.

The letter also states that the 2016 judgment of the Constitutional Tribunal does not constitute a basis “to question the National Media Council itself as the body appointing the applicant’s bodies.”

Let us recall that Bartłomiej Sienkiewicz, due to vetoing the budget for financing public media, put the company into liquidation. It did not mean actual liquidation or cessation of operations, it was only intended to improve the restructuring of public media.
