Produce presented draft insurance rules for artisanal fishermen

This Sunday, January 30, the Ministry of Production (Produce) published the draft supreme decree that approves the regulations of Law 30636, Law that creates the Obligatory Insurance for Artisanal Fishermen (SOPA) and its explanatory statement.

The measure was ordered by ministerial resolution 00030-2022 of Produce, published in the newspaper A Peruvian man, in strict compliance with the provisions of the Fifth Constitutional Court of the Superior Court of Justice of Lima.

In addition, the proposal was also disseminated on the institutional portal www.gob.pe/produce in order to receive comments or contributions from citizens for a period of 30 business days, counted from January 31 to March 11 of this year. .

In the recitals of the standard, it is stated that the Law 30636, in its article 2, establishes that the SOPA acts under the modality of personal accident insurance and covers the risks of death and bodily injury suffered by independent artisanal fishermen and crew members, inside or outside of a fishing vessel, as well as well as non-crew third parties during the fishing task.

This, as a consequence of an accident in which said vessel has participated, including the waters adjacent to the maritime domain, within the limit of the definitions and exclusions established in said law, considering that, in its first final complementary provision, it is provided that the Executive Power regulates the aforementioned norm.
