The measure took effect last midnight. However, the Provincial Government is preparing a third regulation to recover tolls on these roads by the end of 2022.
Since this past midnight the Provincial Council of Gipuzkoa does not charge tolls to trucks that cross its territory through the NI and the A-15, once the ruling of the Superior Court of Justice of the Basque Country (TSJPV), which annulled the rule that protected them, was published in the Official Gazette of Gipuzkoa.
Since the TSJPV ruling that annulled the second provincial rule that regulated truck tolls became final in May, the Provincial Council had continued to collect on the grounds that it had not received the order to publish the sentence.
The Provincial Council is processing a third rule which could be approved at the end of the year, when the numerous infrastructures that it entails will be put out to tender, with which it is estimated that trucks will pay again by the end of 2022.
Regarding the request of the carrier associations that it be return the money paid due to the canceled tolls, the Gipuzkoa Provincial Council has always defended the legality of its collection and discarded, therefore, reimburse these amounts ex officio.
The Deputy for Roads, Aintzane Oiarbide, said a few weeks ago that if someone has legal arguments to request the return, they would have to do so through an “individual claim”, not a collective claim, which should be made before Bidegi or the Diputación itself.
