Arequipa: Cobra clarifies that addendum 13 can still be signed

Addendum 13 can still be signed if the Arequipa Regional Council (CRA) authorizes the Governor Kimmerlee Gutiérrez, the signature of the same, according to sources close to the Cobra concessionaire with whom this newspaper contacted.

The version indicates that “addendum 13 can be signed at any time.” However, “everything depends on the Regional Council making the decision to authorize the signature and that Cobra accepts.”

From the concessionaire, it would be clear that three of the four grounds for requesting the termination of the contract would be resolved if the signature is finalized. In this context, it is borne in mind that Addendum 13 is primarily the responsibility of the CRA. This, by not having authorized the signature to the Regional Government, within the established period would be “responsible for laziness and negligence.”

13 times suspended

The problems of Majes II began from the signing of the contract on December 9, 2010. That same day, the project was suspended due to the legal mess between the regional governments of Arequipa and Cusco due to the waters of the Apurímac River, a tributary that, Through the Angostura dam, it will provide water to the Siguas pampas. From that date to the present, Majes’ contract has been suspended 13 times, all at the request of the Regional Government of Arequipa. The last contractual suspension dates from February 16, 2018, until September 6, 2021. This date was postponed by agreement of the parties until December 30, 2021.

The responsibility for the continuous postponements of the project involves three regional administrations, Juan Manuel Guillén, Yamila Osorio and Elmer Cáceres Llica- Kimmerlee Gutiérrez. The concessionaire warns that the breaches that gave rise to the expiration process of the contract, dragged on since 2014 and are the same as Cobra, puts as a justification for requesting the termination of the contract today.

It should be noted that this It is the third time that expiration has been raised. On January 21, 2016, the Concessionaire requested for the first time the expiration of the contract for the same reasons that are set out in the letter sent on January 10, 2022. The second was in September 2020, the same that was suspended and it reactivated just a few days ago.
