Widow’s pension: if my husband or partner dies, how much money should I receive?

The widow’s pension seeks to support families in times of great loss. The death of a loved one can be one of the most painful times for a person, especially when it is a partner or spouse. In these moments of great grief, it is difficult to focus on the responsibilities that accompany a death. However, even in this difficult time, widows have certain rights and obligations.

One of these rights is access to a pension due to their condition, known as widow’s pensionThis grant is awarded upon proper application, but circumstances may vary for each individual, including the amounts received.

If I become a widow or widower, how much pension should I receive from the State?

All widows in Peru have the right to receive a pensionprovided that their partner has been a pensioner and other established requirements are met. This right is based on Legislative Decree No. 19990.

The widowed wives of pensioners ONP pensioners are entitled to this pension. However, in the case of men, the pension is only granted if they are over 60 years old or if they have a disability. All widowers who meet the above-mentioned requirements will be granted a maximum amount equivalent to 50% of what the insured person was entitled to during his lifetime.

Requirements to receive a widow’s pension

The request of the widow’s pension must be submitted in accordance with a specific format, which includes a sworn statement on the authenticity of the documents. In addition, a simple copy of the Medical Certificate of Disability issued by EsSalud, public health establishments of the Ministry of Health or Health Provider Entities is required.

In the event of death due to an accident, it is necessary to attach a simple copy of the Police Report, Police Report or Autopsy Certificate. If the spouse or member of the de facto union is pregnant at the time of the death of the insured, a simple copy of the Medical Certificate issued by the Ministry of Health, EsSalud or a Health Provider Entity (EPS) must be included.

Other conditions for receiving a widow’s pension

• The spouse or partner of the deceased member or pensioner You must have a disability to work or be over 60 years old.
• The marriage must have taken place at least one year before the death of the member and before he or she turns 60 if he or she is a man, or 50 if she or she is a woman. Alternatively, if the marriage took place at an older age, it must have been at least two years before the death.
• The de facto union must have been established at least two years before the death. If registration was not made, judicial recognition may be requested.

These conditions do not apply in the following cases:

• If the death of the deceased occurred by accident (the police report or the autopsy certificate will be required).
• If you have or had one or more common children (the corresponding birth certificate must be presented if it is not registered with the Reniec).
• If the widow is pregnant at the time of the insured’s death.
