The Plenary Session of the Congress of the Republic approved the new Law on Maritime Cabotage (Project Law 5175/2022-PE), which will allow foreign flag vessels to transship in different ports on the Peruvian coast before reaching their destination.
According to an interview given by Teresa Mera, vice minister of Foreign Trade of the Ministry of Foreign Trade and Tourism (Mincetur) to La República, the approval of the new law will mean savings for Peruvian exporters, among which there are more than 6,600 mypes, more of US$700,000.
The norm, which was worked on within the Transportation Commission, together with Mincetur, regional governments and business associations, was approved in the second instance by the National Representation with 72 votes in favor.
Cabotage consists of the transfer of cargo and passengers by sea between national ports. It is an alternative that complements land transportation, especially when natural disasters occur, in such a way that foreign trade operations continue.
Previously, with Legislative Decree No. 1413 (DL 1413), maritime cargo cabotage could only be carried out by natural or legal persons incorporated in Peru, with national or foreign share capital.
To do this, authorizations were requested from the MTC and the General Directorate of Captaincies and Coast Guard (DICAPI). Now, with the new law approved by the Congress of the Republic, the provisions of the D are modified and complemented..l. 1413, incorporating a new access regime to maritime cabotage.
The new maritime cabotage law may be used, in particular, by the jungle regions for the export of their products by using national ports.
In addition, producing areas may be connected to ports such as Paita and Matarani, by transferring products to these ports for subsequent export shipment. The rule will also favor the operations of the new Chancay Megaport.
