Tumbes runs out of natural gas: Minem confirms expiration of the concession contract

The Ministry of Energy and Mines (Minem) declared the expiration of the Concession of the Natural Gas Distribution System through Pipeline Network of the department of Tumbes, granted to the company Gas Natural de Tumbes SAC almost five years ago.

Ministerial resolution No. 176-2024-MINEM/DM determines the “immediate cessation of the rights of the company Gas Natural de Tumbes SAC”, which were granted to it in light of Supreme Decree No. 040-2008-EM, as well as the concession contract signed on May 21, 2019.

The commercial operation of the concession (beginning of the provision of the natural gas distribution service through a pipeline network in Tumbes) should have been carried out on January 15, 2022. However, Gas Natural de Tumbes SAC did not comply with said obligation.

“Failure to carry out the commercial operation constitutes a cause for serious non-compliance with the concessionaire’s obligations and, consequently, is a cause for termination of the Concession Contract,” the resolution states.

The company was notified of the end of its contract on February 7, 2022, but just a week later it expressed its disagreement and requested the start of a “direct deal” with the Peruvian Government, as contemplated in its contract.

The negotiations did not come to fruition until March 24 of that year and Minem sued Gas Natural de Tumbes SAC before the Arbitration Center of the Lima Chamber of Commerce (CCL).

The ruling favorable to the State arrived in November 2023 and by February 2024 the company was notified of the start of the expiration of the natural gas distribution contract in Tumbes, which finally became official today.

Tumbes has been waiting for the arrival of natural gas since 2019

On May 21, 2019, the General Directorate of Hydrocarbons (DGH) of Minem, representing the Peruvian State, and the company Clean Energy del Perú SRL signed the Concession Contract for the Natural Gas Distribution System through the Department’s Pipeline Network. from Tumbes.

By December of that same year, Clean Energy approved the transfer of contractual position to the company Gas Natural de Tumbes SAC (GNT), an agreement that was signed on January 15, 2020, the latter becoming the concessionaire, with all rights and obligations.
