According to the National Superintendence of Labor Supervision (Sunafil), service providers can file a complaint against their employer or the company in which they carry out their activities.
Although these workers are not on the payroll, they do not have access to social security or pensions, the inspector ensures that under certain requirements they can report an event. The service provider must file his complaint while working at the company. Additionally, he must attach the following:
- Emails or attendance logs to demonstrate that a service is provided to the employer.
- Proof of payment, such as bank slips or receipts for ongoing fees.
- Evidence of subordination, that is, that he had a superior who gave him instructions or orders to carry out his work. This can also appear in emails or WhatsApp conversations.
Additionally, you must indicate the company’s RUC, address, a personal cell phone number and an email.
Complaints can be submitted in person at any of the 26 Sunafil municipalities nationwide or virtually on its website.
