The Sunafil Labor Supervision Court issued Resolution No. 830-2023-Sunafil/TFL-First Chamber, which analyzes the impact of the lack of vacations on employees. In it, it states that if the worker did not enjoy his vacation in the immediately following year after acquiring it, the payment of vacation remuneration and vacation compensation is not sufficient in the event of said violation, despite the fact that this was previously done, according to with article 23 of legislative decree 713.
“Thus, under this erroneous reading, it would be intended to remedy the effect of the lack of vacation rest with an economic benefit derived from such regulation, even while payment of the vacation compensation component is pending,” the Court’s resolution states. of Labor Supervision
What does the Sunafil resolution say?
The Resolution No. 830-2023-Sunafil/TFL-First Chamber is part of a complaint against a company that was sanctioned for “not carrying out periodic surveillance tests on the health status of workers” and classified it as a serious offense with a payment of S/5,670. This sets a precedent in which it is indicated that if the worker reports that he has not been able to take his vacation, his workplace can be financially penalized.
The Labor Supervision Court points out that the protection of this rest time is important because it allows the realization of various needs such as conciliation of family responsibilities, personal life and leisure, among other aspects.
How can you avoid sanctions?
According to the Echecopar Study report, employers are recommended to review the staff’s vacation record, with the aim of scheduling this break at the optimal time and avoiding its expiration. Furthermore, if they manage to identify that there are some vacations that are about to expire, negotiate with the worker on reduction agreements, thus eliminating the incentives to report the company.
