On Friday, December 8 and Saturday, December 9, two national holidays will take place in Peru, which can be taken advantage of by the public and private sectors. However, if you carry out your work normally on said date due to the field in which you work, the Legislative Decree No. 713 indicates that your employer must pay you an amount greater than a normal day’s work.

As part of their rights, workers must receive a triple payment, but what is this amount made up of and how to calculate the amount? In this note, we tell you.

How much should I be paid if I work on December 8th and 9th?

According to the manager of the CCL Legal Center, Alvaro Galvezthe amount to be received by people who work during the holiday is composed as follows:

  • The remuneration corresponding to the holiday (already included in the monthly salary you receive).
  • The daily payment corresponding to the labor performed.
  • An additional amount equivalent to a surcharge of 100% of the corresponding daily remuneration.

For example, if a worker receives S/50 per day for his services and must perform duties normally on Friday, December 8 and Saturday, December 9 —without the possibility of obtaining a substitute rest—, the amount he will receive must be calculated as follows : S/50 for the holiday, plus S/100 for the work done (100% surcharge) on each of these days.

If my day of rest falls on December 8 or 9, how much should I receive?

Regarding this point, the manager of the Legal Center of the Lima Chamber of Commerce, Alvaro Galvez noted that workers whose weekly rest days coincide with this date will receive double remuneration: a salary corresponding to their weekly rest and an additional one due to the holiday.

If my vacation coincides with the holiday of December 8 and 9, how much should I receive?

In this specific case, the CCL director indicated that people who are enjoying their vacations while a national holiday is taking place are not entitled to an additional payment.
