July 27, non-working day: how much should I be paid if I work on this date?

In a few days, Peruvians will celebrate the Fiestas Patrias 2023. In addition to the traditional holidays of July 28 and 29, a non-working day has been included in the national calendar that will be part of the next long weekend. How much should I be paid if I work on July 27?

In accordance with the provisions of Legislative Decree 713, Law on paid breaks, July 27 is a non-working day for state workers. In the case of the private sector, there must be coordination with the employer in order not to carry out the workday of that day and, later, to recover the hours of rest time.

In this sense, the Chamber of Commerce of Lima indicated in a press release that people who work on a non-working day like July 27 will receive a simple payment, without surcharge. In addition, they remember that said date is a working date for tax purposes and that any agreement with the employer for eventual compensation may be made with all or some of the workers.

How will compensation be made for hours that will not be worked on July 27?

According to article 2 of Supreme Decree 151, which establishes the non-working days in the year, the hours that were not worked on July 27 in the public sector must be recovered from the date following the non-working day and for a period of 10 immediately subsequent days. SIf we take into account that there is a long holiday until July 30, the compensation would be approximately 1 daily working hour between Monday, July 31 and Friday, August 4, as well as from the 7th to the 11th of that same month.

In the case of the private sector, a prior agreement between the worker and the employer is essential to enjoy this break and recover the hours, as discussed with the person responsible for granting this permit. If there is no acceptance by both parties, who will ultimately decide will be the employer.

Why is July 27 a non-business day?

With the aim of promoting tourism in the country and various recreational economic activities, the Executive Branch published Supreme Decree 151-2022-PCM, which establishes that public sector workers may enjoy a long holiday, in addition to the traditional July 28 and 29. As for the private sector, employees must coordinate with their employer to take advantage of this measure.
