From what time does the night work start and how much do they have to pay? MTPE responds

Nighttime work hours in Peru, unlike daytime, has some differences, such as the amount of salary. Therefore, to better guide the public, the Ministry of Labor and Employment Promotion (MTPE) published a guide for the worker at night, which is based on current labor regulations. In this way, the worker will be able to know from what time your schedule officially starts and how much you should charge.

Below, we will tell you more details about the guide that the MTPE made available on night work hours.

From what time does night work begin, according to the MTPE?

According to the MTPE, based on Article 8 of DSN° 007-2002-TR, the night work schedule consists of the tasks that are carried out between 10:00 p.m. and 6:00 a.m.

How much should they pay during night work hours, according to the MTPE?

The night-time worker must earn, at least, a monthly salary equivalent to the minimum vital wage (RMV), that is, S/1,025, increased with a surcharge of 35%, which would be a total of 1,383.75 soles.

Regarding daily, weekly or biweekly remuneration, these will have to be calculated proportionally on said sum.

Another precision made by the MTPE guide is that, when the working day is carried out during the day and at night, the additional surcharge for working at night will have to be applied, considering only the time worked between 10:00 p.m. and 6:00 a.m.

How much must they pay during night work hours in the case of micro-enterprises?

The remuneration varies in what refers to micro-enterprises, since in this case the additional surcharge for working at night should not be applied. In other words, the monthly salary will be at least one RMV (S/1,025).

However, with respect to small companies, the 35% surcharge must be applied, so the monthly salary must be at least the minimum nightly wage (S/1,383.75).
