This Wednesday, June 28, it was published in the Official Gazette El Peruano a measure of Sunat that approves the discretionary power not to penalize people and businesses that fail to comply with the obligation to record the RUC and the company name by offering goods and services through physical or digital mediaas the entity had warned a few weeks ago.
RUC on social networks: they will not sanction until the end of the year
The resolution provides for a “White March” and facilitates a adaptation period that goes from July 1 to December 31, 2023in order for interested parties to find out about the procedure they must follow to enter their RUC number in the publications they make and do not receive sanctions.
Giorgio Balza, principal associate of Cuatrecasas, explains that this new measure aims to facilitate compliance with the tax obligations of the taxpayers. “For this, the Sunat has considered it convenient to have measures that allow additional time to adapt to this new provision,” he details.

This measure comes at a key moment due to the fact that the standard was made mandatory since July 1, in accordance with Legislative Decree 1524. In addition, it occurs after in recent weeks the lack of clarity in the norm was noticed which also includes influencers and youtubers.
Congress: project seeks to repeal Sunat rule
Let us remember that the Avanza País congresswoman Adriana Tudela presented a bill, last Wednesday, June 21, to repeal this rule because it violates the freedom of enterprise and blurs the main objective of making advertising.
“It is expected that, if the rule is not repealed, Sunat can establish the form, conditions and other requirements that must be observed for the adequate fulfillment of this obligation”, indicates Giorgio Balza.
According to Sunat, with the benefit of discretion it is expected to promote the formalization of around 200,000 taxpayers who are mainly engaged in electronic commerce.
