They propose that users receive 20% of the fine paid by companies for infractions

the congresswoman Katy Ugarte Mamani (not grouped) proposes to establish an incentive for the complaining consumer, of a bonus and non-compensatory nature, of 20% of the total fine against the provider that has been sanctioned by Indecopi or another entity. It should be noted that today users do not receive any part of the fine that companies pay for violations, the money is collected by the sanctioning body.

The purpose of Bill 5208 is to modify article 110 of Law 29571 (Consumer Protection and Defense Code) on administrative sanctions to add the following text:

“After the administrative sanctioning procedure is completed, the complainant is a creditor of 20% of the total fine against the provider established by Indecopi or any other regulatory body, as an economic incentive for your complaint. This monetary amount is of a bonus nature and not compensatory or compensatory.”

“Beyond the restitution of the property or the return of the amount paid, consumers do not receive any monetary amount for reporting, due to the fact that reparative protection is only given before the judicial process and not the administrative one, many consumers find themselves little motivated to go to denounce”, is exposed in the document.

It is necessary to remember that in the previous legislative period, PL 3352 was presented, which sought that users receive 50% of the fines imposed, but it was archived. While in the current period PL 3209 was presented, with the same objective, but it is of a compensatory nature for damages and prejudices, and already has a favorable opinion to be scheduled and debated in the Plenary of Congress.

Ugarte’s initiative must be analyzed by the Consumer Defense Commission before going to plenary for debate and voting.
