Paracas: the company is fined S/2 million for misleading advertising about its 40-meter toilet paper

Indecopi sanctioned, in the last administrative instance, trash can kings for disseminating misleading advertising in their digital media such as web page, social networks and influencers. In his commercial advertisement, he claimed that the rolls of toilet paper Paracas Black Premium had a length of 40 meters despite not having the elements that prove said statement.

In this regard, the Specialized Chamber for the Defense of Competition of the aforementioned body imposed a fine of 482.78 UIT, which is equivalent to S/2 million 389,761. According to the entity, the company incurred in acts of unfair competition in the form of deception.

During the investigation, it was found that none of the evidence provided by Papelera Reyes, such as the technical file, notarial certificate, laboratory and internal report; They were enough to prove the veracity of the message transmitted in the advertising.

“For example, the tests did not record a production datethey did not include any study that supports the results, they did not follow the proper procedure for the inspection of the sample or they were issued at a later date than the beginning of the dissemination of the advertising”, reads the Indecopi statement.

Paracas paper must be rectified

The sanctioned paper company must also comply with corrective measures, as the definitive and immediate cessation of the aforementioned advertising campaign, in addition to the publication of a notice of rectification in the same media in which they propagated the advertisements.

Article 8 of Legislative Decree No. 1044 —Unfair Competition Suppression Law—, indicates that acts of deception have the effect, real or potential, of misleading other agents in the market regarding the nature, method of manufacture or distribution, characteristics, aptitude for use, quality, quantity, price and conditions selling.
