Fonavi: Economy Commission approves opinion to allow partial refunds

This Wednesday, May 17, the Economic Commission of the Congress of the Republic unanimously approved the opinion that seeks to authorize partial refunds of the money owed to the exporters to the National Housing Fund (Fonavi), charged to a subsequent cancellation. Besides, simplifies the process so that the heirs of deceased workers can collect the amount that corresponds to them.

As recalled, the ad hoc commission has almost S/2,000 million in its accounts to reimburse; however, this process has not started because the law states that the refund is total and not partial or on account.

Bill 4702, by congressmen Ronsangella Barbarán and Noelia Herrera, proposes to modify Law 29625 so that the ad hoc commission delivers, within a maximum period of 120 days, certificates of recognition of contributions and rights (Cerad).

Likewise, it authorizes the commission to make payments on account of the total amount of the return process of the individual account of each ex-contributor to Fonavi.

It was also approved to recognize the right to return to the heirs of deceased workers, indicating that, when the amount to be reimbursed exceeds S/19,800 (4 UIT), the legal regulations on inheritance issues will be taken into consideration, Therefore, it will be required to have the right registered in the public records.

Whereas, when the sum is less than 4 UIT, it is only required to present the documentation that proves the hereditary condition of the beneficiaries and the simple affidavit of the same ratifying such condition. The opinion must be debated and approved in plenary for its official promulgation.
