In the last few hours it became known that the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) imposed an economic sanction of 35.94 UIT on the Nestlé company, which is equivalent to a sum of S/173,448 due to acts of deception towards the consumer, specifically for misleading advertising on the packaging of the “Maggi Meat Cube 100 mg”.
The measure was imposed after accepting the complaint from the Association of Consumers and Users of Ancash (Acurea) at the beginning of 2022, in which he accuses the multinational of infringe the Legislative Decree 1044 when detecting that the product does not contain meat, but its presentation suggests that it does.
Likewise, the company must assume the costs that the legal process generated in Acurea, who will also benefit from 36.75% of the total fine paid nestle. For its part, the food and beverage company was also informed that it should not continue to broadcast advertising that implies that the product contains meat to avoid confusion.
Nestlé’s response after being sanctioned
Nestlé provided its defenses on the accusations against it. “The appearance of the image of a caricatured bovine and a plate of food with pieces of meat it does not convey the advertising message that the product has meat as its main ingredient, but rather that the product is a flavoring and for this reason a dish that has precisely the meat-flavored seasoning is shown”, the company responded to Indecopi.
“A reasonable consumer would not think that such a small cube contains meat,” he stated.
