PGNiG appealed against the judgment of the CJEU. It is about an agreement between the European Commission and Gazprom

The Polish company stated that it maintained its negative assessment of the obligations assumed as part of the settlement concluding the antimonopoly proceedings. In their opinion, they did not ensure the restoration of competition in the Central and Eastern European market.

“PGNiG hopes that the Court of Justice of the European Union will share the arguments presented in the appeal, and that Gazprom’s actions involving the abuse of its dominant position will meet with a decisive reaction from the European Commission to actually ensure equal conditions of competition on the European gas market.”

Gazprom was accused of obstructing gas trade and inflating prices

The dispute over monopolistic practices has been going on for years. In 2012-2018, the European Commission conducted proceedings in this case in Central and Eastern Europe, including Poland. The accusations against Gazprom related to obstruction of gas trade on the European market, as well as artificially high gas prices. In relation to Poland and Bulgaria, the accusations of linking trade conditions with issues related to gas infrastructure were formulated.

The proceedings ended in May 2018 with the acceptance by the European Commission of Gazprom’s obligations aimed at restoring competition on the markets of Central and Eastern Europe, and with the withdrawal from imposing a fine on the Russian company for violating competition law.

Gazprom’s commitments were to guarantee the free flow of gas between EU Member States, contractual mechanisms to ensure competitive prices for the Russian company’s customers, and the company’s non-enforcement of benefits related to control over gas infrastructure in individual Member States.
