The first letter to the Polish authorities from the European Commission was sent on Tuesday morning. The second letter was sent in the evening of the same day. In it, the Commission announced the deduction of EU funds for the second period of fines charged for, i.e. from October 20 to November 18. The first letter, in turn, indicated the period from September 20 to October 19. The European Commission will deduct a total of EUR 30 million, including penalty interest.
“is launching a compensation procedure in order to deduct the unpaid penalty by Poland for not excluding the Turów mine from EU funds. The European Commission is using this tool for the first time. The Commission will start with about 15 million euros, but the penalty has already exceeded 60 million” – he wrote on Tuesday morning on Twitter Jorge Valero, a Bloomberg reporter.

However, the European Commission believes that the fines that have already been applied since September must be repaid. The Prime Minister said last week that Poland will demand the cancellation of penalties and will take all legal and political measures in this matter.

CJEU penalties for Turów “unlawful”. Government: We just won’t pay them
Meanwhile, Deputy Minister of Infrastructure, Marcin Horała, said on Tuesday on Polish Radio 1 that Poland would not pay penalties for Turów. The government considers that the imposition of penalties for the operation of the mine was unlawful.
Marcin Horała stressed that Poland will block any attempts to deduct penalties from EU funds. – These penalties are not due, so we will simply not pay them, and if the European Commission in these circumstances unlawfully deducts these amounts from other amounts, then we will use all available funds to block such actions – announced the deputy minister of infrastructure.
