Donald Trump has filed a lawsuit to prevent the White House documentation from when he was president be handed over to the congressional commission that investigates the assault on the Capitol of January 6, 2021.
The lawsuit was filed in Washington on Monday to block the investigation, “an illegal and vexatious fishing expedition”, According to the document. Thus, they ask the federal justice to invalidate the commission’s request for documentation to the National Archives, reports the ‘Political’ portal.
In particular, they ask that it not be delivered no document covered by the “executive privilege” that protects the president and that in any case they are allowed to previously review that documentation before it is delivered to Congress, a process that could take years. This lawsuit opens a complex legal battle over Congressional investigations and executive privilege.
The Supreme Court recognized during the time of Richard Nixon that former presidents may have a legitimate interest in preventing the publication of documentationBut Trump’s would be the first dispute between an incumbent president and his predecessor when it comes to executive privilege.
The lawsuit is the result of months of work in response to the petition launched by Congress to the National Archives asking all communications from the Trump Administration regarding the assault to the Capitol.
The first shipment of documentation was reviewed by Trump’s lawyers, who consider that several of those documents would be protected by executive privilege, a concept that theoretically only applies when the delivery of that documentation affects the functioning of government functions. However, the Administration Biden has supported the delivery of that documentation.
