The Government of the President of USA., Joe Biden, announced this Thursday that it will accelerate judicial processes for adult asylum seekers who enter the country alone, within the framework of the measures taken to control the arrival of migrants at the border between the United States and Mexico.
The Department of Homeland Security (DHS) and the Department of Justice (DOJ) explained that the new judicial rule, known as the ‘recent arrivals (RA) file process’, will allow asylum seekers’ cases to be resolved in a period of 180 days, which will reduce a process that can take years to months.
The move, which marks the latest effort to streamline the processing of thousands of migrants who arrive irregularly, imposes consequences “more quickly,” including deportation, on those who do not have a legal basis to remain in the United States, the DHS said in a statement.
The initiative will also more quickly grant protections to asylum seekers with valid claims.
The prosecutor of USAMerrick Garland, said in a statement that the initiative will allow immigration cases to be resolved “promptly and fairly.”
For his part, Homeland Security Secretary Alejandro Mayorkas warned in a statement that the measure “does not replace the radical and much-needed changes that the bipartisan Senate bill would produce, but in the absence of congressional action we will do everything “We do what we can to enforce the law in the most effective way and discourage irregular migration.”
The new measure will initially apply to single adults who are released from Immigration and Customs Enforcement (CBP) custody and are headed to one of the following five cities: Atlanta, Boston, Chicago, Los Angeles and New York .
Immigration judges will attempt to make final decisions within 180 days, although the time to make a decision in particular situations will remain subject to the specific circumstances of the case and the right to due process, including allowing noncitizens time to seek legal representation.
This Thursday, the DOJ also presented a rule for judges of immigration can give priority to cases that can be resolved promptly, in order to apply more efficiency and speed to work management.
