To control the spread of COVID-19, the President Joe Biden announced that companies with 100 or more employees should require vaccination or subject their workers to weekly tests for coronavirus. The rule was due to take effect on January 4 and would affect some 84 million people across the country.

But shortly after its publication by the Occupational Safety and Health Administration, multiple legal appeals were filed from Republican companies, conservative groups and prosecutors who alleged that the agency does not have the authority to require vaccination.

On November 6, a federal appeals court in New Orleans suspended the rule, saying it was too broad. Ten days later, all appeals to the mandate were consolidated in another appeals court in Cincinnati.

In a court document, lawyers for the Biden government argued that the requirement was necessary to reduce transmission of the virus in the workplace and called for its application to be allowed.

That of the companies is one of the vaccination requirements of the Biden government appealed to the courts. The same is true for two others, one for healthcare workers and one for federal contractors.
