Cadena is being investigated for the same case for which Uribe is being investigated, and he is accused of allegedly having tampered with witnesses.
A Colombian judge on Wednesday revoked the freedom of Diego Cadena, former lawyer of former President Álvaro Uribe (2002-2010), accused in the case of manipulation and bribery of witnesses for which the former president is being investigated, and sent him to house arrest.
Iván Cancino, Diego Cadena’s lawyer, confirmed the judge’s decision on his social networks and described it as “absolutely unfortunate”, since his client had been released on October 13 by another judge on the grounds that he had already overcome the time allowed by law to remain in detention without being sentenced.
“The guarantees of the defenses continue to be weak for the defense. Do not worry, we will sing again and soon. Always firm and with the soul, ”Cancino wrote on Twitter.
Cadena is being investigated for the same case for which Uribe is being investigated, and he is accused of allegedly having manipulated witnesses in favor of his client.
Uribe’s former lawyer was charged by the Prosecutor’s Office for allegedly visiting several former paramilitaries in prisons, including Carlos Enrique Vélez, to whom he allegedly gave money to change his testimony in favor of the former president.
The lawyer, known for having defended drug traffickers, has accepted that he did give money to Vélez, but assures that it was not a bribe, but rather “humanitarian aid”, and insists that he was extorted by the former paramilitary.
Justice had denied the lawyer’s release last June, because it considered that, despite the expiration of the terms, the defense made requests that have led “to unjustifiably extend the preparatory hearing.”
However, another judge studying an appeal from Cadena’s defense considered otherwise in October; and today another court sent him back to house arrest.
“Judge 43 of hearing revokes the release decision due to expiration of Diego Cadena’s terms. It accepts the thesis of my lawyer, Reinaldo Villalba, and the prosecutor that the term has not expired to start the trial, as a result of delaying practices of the defense, “said leftist senator Iván Cepeda, who is a victim in the case of the Ex leader.
The Uribe case
The process began in February 2012, when Uribe sued Cepeda for alleged witness tampering, who at that time was preparing a complaint in Congress against him for alleged links to paramilitarism.
That lawsuit ended up turning against Uribe when Judge José Luis Barceló not only shelved it, but also decided to open an investigation into the former president for alleged manipulation of witnesses.
The prosecutor in charge of the case, Gabriel Jaimes, asked on March 5 not to investigate Uribe, leader of the ruling Democratic Center party, considering that “several of the behaviors for which the former congressman was legally linked do not have the character of a crime and others that are, cannot be attributed to him as an author or participant ”.
