What is Title 42 about and how long will the measure last in the US?

Have you heard of Title 42? This is a sanitary measure that began to be applied in the United States land border with the arrival of the COVID-19 pandemic to prevent the passage of immigrants and that the Joe Biden government has already set an expiration date.

The Supreme Court ordered the Biden government in December to maintain Title 42 in a precautionary manner and this has allowed the expulsions of people from Cuba, Nicaragua and Haiti to be maintained. It is also used to expel Venezuelans, Mexicans, Guatemalans, Hondurans, and Salvadorans. Find out how long the measure that has allowed millions of expulsions will last.

WHAT IS TITLE 42?

The so-called Title 42 is a health policy that was created in the early days of the COVID-19 pandemic, on March 20, 2020 -during the administration of Donald Trump-, to prevent the spread of the virus.

The measure allows Customs and Border Protection (CBP) authorities to expeditiously expel migrants at US land borders who “potentially pose a health risk”.

According to CBP, people who are apprehended are not held in congregate areas for processing and are immediately removed to their country of last transit, which is Canada and Mexico. Unaccompanied migrant minors are exempt from this measure.

UNTIL WHEN WILL TITLE 42 BE IN EFFECT IN THE UNITED STATES?

The Department of Justice announced Thursday, February 9, that the United States government plans to end on May 11 to Title 42, a sanitary norm that allows expulsions at the country’s border and that has been criticized by non-governmental organizations and international organizations.

In a document filed with the Supreme Court, the Government of President Joe Biden assured that when the declarations of national emergency and health emergency due to the COVID-19 pandemic are lifted, Title 42 will also be suspended.

HOW MANY PEOPLE HAVE BEEN REMOVED UNDER TITLE 42?

Title 42, the health order that was implemented in March 2020 to control the spread of COVID-19, has been used to turn away undocumented immigrants more than 2 million times on public health grounds, denying them the right to petition asylum.
