The United States immigration service announced Monday the opening of a digital window that allows asylum seekers to request a work permit (employment authorization) online.
The measure that comes into force as of this week is intended for those asylum seekers who have an employment authorization under category (c)(8), that is, political asylum.
The Office of Citizenship and Immigration Services (USCIS) said that from now on “certain asylum seekers can file online Form I-765 or the Application for Employment Authorization, EAD.”
If you apply to any of these five immigration programs, you can live legally in the United States
“Effective immediately, applicants for employment authorization under category (c)(8) (Pending Asylum Applicants and Withholding of Removal and Pending Asylum Applicants under the ABC Settlement Agreement), may file Form I-765 online,” the agency explained.
This benefit may also be obtained by those who benefit from the “withholding of removal”, by which they are allowed to stay despite an expulsion order, due to well-founded fear that they are in danger in their countries.
This is how the United States will make it easier for asylum seekers to apply for work
Those who have requested asylum and want to process a work visa must do so through Form I-765, 150 days after submitting their asylum application. What changes is that now this presentation can be done online.
Likewise, migrants will be able to request a card and social security insurance through the same form.

- Create an account at my.uscis.gov.
- Form I-765 is available on the site.
- Online filing is only available to certain categories of Form I-765 applicants, which now include asylum applicants.

- Immigrants with a pending Form I-485
- Application to Register Permanent Residence or Adjust Status
- Immigrants with a pending Form I-589
- Application for Asylum and Withholding of Removal; Individuals with nonimmigrant status that allows them residence in the United States, but requests permission from USCIS to accept employment (i.e., an F-1 or M-1 student)
If you submit Form I-765 online to apply for employment authorization and you do not apply under an eligible category, USCIS may deny your application and withhold the fee. The filing fee of $410.
The measure comes amid a major immigration crisis that can be seen on the southern border of the United States, where thousands of migrants wait to enter the country. Only last December some 300,000 undocumented people were detained in the country.
According to official data, from last October to December 31, the United States Customs and Border Protection has made 863,929 arrests, compared to 205,691 in the same period of fiscal year 2022. (YO)
