On September 15, the Sejm passed an act amending the act on energy performance of buildings and the act – Construction Law. 387 MPs voted in favor of the amendment, nine were against and 52 abstained.
As explained, “the project concerns the adaptation of Polish law to the EU regulations on the energy performance of buildings; the new solutions also result from the need to improve the effectiveness of the current system for assessing the energy efficiency of buildings in Poland”.

What are the new regulations?
The Act covers:
- Introducing changes to the requirements related to the control of heating systems and air-conditioning systems, extending the range of systems with a capacity of over 70 kW covered by the obligation to control.
- Enabling universal access to the basic information contained in energy performance certificates collected in the central register of the energy performance of buildings.
- Introducing an obligation for investors (including developers and individual investors) to attach building energy performance certificates to the notice of completion of construction or an application for an occupancy permit.
- Introducing the obligation to install automation and control systems in certain buildings, in accordance with EU regulations.
Building energy performance certificate. Expensive duty
This is not the end – the new law introduces the obligation to prepare energy performance certificates for each single-family or multi-family building.
The regulatory impact assessment shows that the price of such a certificate will be approximately PLN 300, but the final cost will depend on several factors – e.g. the type of heating, hot water, ventilation and air conditioning system used. “Nevertheless, probably in the vast majority of cases [cena – red.] is not higher than PLN 300 “- we read.
The new regulations are to enter into force six months after the date of announcement.
