“The Meeting of Prosecutors performing official duties in the National Prosecutor’s Office states the following: as a law protection authority, it is responsible for upholding the rule of law and prosecuting crime. It is therefore responsible for the legal security of the state and citizens. Any extra-legal activities aimed at disrupting the functioning of the prosecutor’s office lead to organizational and decision-making chaos and, in fact, they are a tribute to the criminal world,” we read in the statement.
The National Prosecutor’s Office posted a second entry. In the first one she advised “Switch to a better Gmail”
“Without denying the need for systemic changes in the Public Prosecutor’s Office, it should be emphasized that the only legal way to reforms may be changes to applicable legal acts in the manner provided for by the Constitution of the Republic of Poland. Any actions of the executive authority which, instead of applying the law expressed in constitutionally defined sources, should be opposed. , uses legal opinions prepared on behalf of private law firms,” it added.
The National Prosecutor’s Office writes that “making changes in the functioning of such an important institution for the state as the Prosecutor’s Office, instead of following the statutory path based on questionable legal opinions, may lead the prosecutor’s profession to a crisis, which we observe in courts where two groups have developed – judges and so-called neo-judges. Such a situation should be avoided at all costs in the Prosecutor’s Office.
It was stated that “possible actions of unauthorized persons in the area of appointments to prosecutorial positions will inevitably lead to the separation of a group of neo-prosecutors, which will have an impact on hundreds of thousands of preparatory proceedings ongoing in Polish prosecutor’s offices. This would be a basis for questioning the procedural decisions made in these cases , or the right to appear before courts as a public prosecutor.
We, prosecutors, express our firm opposition to unethical actions that constitute personal, non-objective attacks on prosecutors conscientiously performing their duties. Personal attacks are largely targeted at prosecutors conducting complex and multi-layered criminal proceedings. Public criticism of prosecutors, without knowledge of the circumstances of the cases, significantly weakens the position of these prosecutors in contacts with people facing serious criminal charges and the lawyers representing them. This is a violation of the well-understood professional solidarity of the entire prosecutorial community, focused on fighting crime in their daily work, and is a violation of the oath.
– we read.
The National Prosecutor’s Office adds that “on behalf of nearly 1,000 prosecutors who perform official duties as part of delegations in prosecutor’s offices throughout the country, we strongly protest against the words about ‘PiS delegations’ that were uttered in one of the press interviews.”
“We are not on ‘PiS delegations’. We are prosecutors of the Republic of Poland performing official duties on a daily basis, including as part of delegations. However, we know the problem of staff drain in district prosecutor’s offices. Therefore, in our opinion, it is necessary to create new judicial and non-judicial positions to ensure the efficient functioning of the Public Prosecutor’s Office. , as well as the creation of statutory mechanisms guaranteeing obligatory job promotion for delegated prosecutors,” it was added.
“In order to prevent these negative processes, we call for a round table for the prosecutor’s office to be convened in consultation with representative organizations, the aim of which would be to defuse tensions and start talks on the reform of the prosecutor’s office based on a broad consensus of the entire prosecutor’s community. We appeal to all legal circles: let’s stop personal attacks on other lawyers! Let’s restore a civilized discussion about the State and the law without the use of ‘legal hate speech’, let’s focus on serving Poland and its citizens,” we read at the end of the entry of the National Prosecutor’s Office.
