If the person was married to a US citizen and was a victim of abuse and has applied for VAWA (Violence Against Women Act) and obtained a residence permit through VAWA, he will have to wait not five but three years.
Although the person has been granted a residence permit by work, by a resident brother or spouse, or by parents, the waiting period is generally five years.
